NIW (National Interest Waiver)

NIW is a self immigration visa petition.  It allows an alien by his or her self to petition for an immigrant visa without need of an employer's sponsorship.  NIW is an attractive option for professionals, especially for those engaged in basic and applied research.

To qualify for NIW, a petitioner generally must have an advanced degree, which is defined as a master’s degree and above.  A petitioner must conduct research in a particular field of sciences, arts, business, etc.  The research must have some sort of value to the society and must be relevant to U.S. national interest. More importantly, a petitioner must have made specific prior accomplishments to justify future projection that he or she will make substantially greater contributions to his or her field than vast majority of his or her peers with comparable background.

For NIW, recommendation letters play a critical role, which are one of the most important parts of a NIW petition. 

Furthermore, for a successful NIW petition, a well-drafted attorney's petition letter is critical.  A good attorney's petition letter must lay the foundation on factual elements in particularity while properly interpreting legal elements.
